A lawsuit brought against ‘Wen’ shampoo creator, Chaz Dean, and its distributor, Guthy-Renker, has been given a preliminary clear to go ahead by a federal judge in Los Angeles.
The class-action lawsuit, which is seeking more than $26 million, claims the cleansing conditioner caused hair-loss, scalp irritation and balding. The lawsuit is comprised of 200 members.
The Food and Drug Administration is currently sifting its way through thousands of complaints received by Dean and Guthy-Renker after they issued a safety alert for the product back in July due to 137 complaints.
In an interview with CBS Los Angeles attorney, Amy Davis, said, “From what we understand about the product and how it causes hair loss is it contains virtually no cleanser. It’s like using lotion to wash your hair. So instead of removing the product when you rinse it off, it just becomes impacted in your hair follicle.” Source: Chaz Dean
Creator Chaz Dean is standing behind his product, revealing, “We continue to provide our hundreds of thousands of customers with the Wen by Chaz Dean products that they know and love. Since the process of litigation is time consuming a costly, we made a business decision to pursue a settlement and put this behind us so that we can focus on delivering quality products.”
If approved by a U.S District Judge, recipients could see a payout of $25 to anyone who purchased a bottle of the offending shampoo and $20,000 to those who suffered from adverse reactions.
